Canada opens door to Palestinians displaced in Gaza war Immigration minister announces pathways for displaced Palestinians with connections to Canadians to seek refuge. Those who are already in Canada will be allowed to extend their stay in the country without having to pay for any application fees for study and work permits. Israelis currently in the country are also eligible to the fee-exempts permits if they, too, left Israel or the Palestinian territories on or after Oct. 7, 2023, when the conflicts began. All existing and new permanent residency applications for Palestinians within family reunification streams will also be prioritized.ARTICLE CONTINUES BELOWFor those who are still stuck in an "unlivable" Gaza, Immigration Minister Marc Miller said Canada will offer temporary resident permits, but he said it is still uncertain whether they can get through the border guarded by Israeli authorities. "I would like to stress that it's extremely difficult to leave Gaza and (it) may not be possible for everyone as countries set their own entry and exit requirements," Miller told reporters at a news conference Thursday."We will do our utmost to assist but cannot guarantee safe passage. The retaliatory siege, bombardments and ground attacks have left 19,600 civilians and combatants in Gaza dead.Initially Canada and other western countries affirmed Israel's right to defend itself in the wake of the Hamas attack. On the one year anniversary of the Court’s unprecedented judgement in Tafreshi v. M.C.I., we are both happy and disappointed: happy for our clients who have since been approved and starting their lives in Canada; and, disappointed that the continued conduct of the Minister is exasperating the systemic problems proven in the initial case. There are now 3 group litigations addressing the Minister’s assessment of self-employed applications. The first group, the Tafreshi applicants who exposed the “calculated decision” by IRCC management to deprive applicants of their procedural fairness rights, continue to experience various procedural fairness violations requiring Ms. Jafari to return to Court a third time in the year since the judgement. The second group, Tanhaei v. M.C.I., is for those refused by IRCC without so much as a document request, regardless of the date of refusal and visa post. The third group, which is presently forming, is for those refused by IRCC since the Tafreshi judgement with at least a superficial adherence to procedural fairness requirements, but wherein the standard to be met remains unreasonably high based on communicated eligibility criteria. Each misstep of the Minister reinforces our passion and efforts for a just outcome for self-employed applicants. Just finished settling 20+ WP refusals in the Start-Up program for lack of understanding by officers of program requirements; now seeing similar refusals for WP under the Self-Employed program.Extra points if you can guess the visa post? .... In the ongoing saga of the 110 applicants seeking a just assessment of their Self-Employed applications, we are delighted to report having put a stop to ongoing games by Canadian Immigration and Citizenship regarding the required documents on reassessment. The Court has confirmed that business plans and detailed evidence of past work experience are not required, a position we tried to obtain from Sean Fraser for the last 7 months and kept getting the runaround.
